第1条（適用）

本規約は、個人開発者（以下「当方」）が提供するアプリケーション「SpeedTracker」（以下「本アプリ」）の利用に関し、当方とユーザーとの間の一切の関係に適用されます。ユーザーは、本アプリをダウンロード・利用した時点で本規約に同意したものとみなされます。

第2条（サービス内容）

本アプリは、ユーザーが写真ライブラリから選択した動画、またはライブカメラの映像から、車両を検出・追跡し、路面のホモグラフィ（透視変換）に基づいて速度を推定・ランキング表示する機能を提供します。あわせて、映像内のナンバープレート等の文字をオンデバイスで認識する補助機能を備えます。これらの処理はすべて端末内（オンデバイス）で完結し、映像や解析結果がネットワークを通じて外部へ送信されることはありません。

第3条（価格・購入）

本アプリの提供形態および価格（無料・有料・アプリ内課金の有無を含む）は、Apple App Store の本アプリのストアページに表示される内容が正式なものとなります。ストア表示価格が優先します。購入・支払い・返金については Apple App Store の規約およびポリシーが適用され、当方は原則として直接の返金対応は行いません。

第4条（ライセンス）

当方は、ユーザーに対し、本アプリを私的利用の範囲内で利用するための、限定的・非独占的・譲渡不能なライセンスを付与します。ユーザーは、本アプリの逆コンパイル・逆アセンブル・リバースエンジニアリング、複製、再配布、貸与、販売、または本アプリに同梱される機械学習モデル・アセットの抽出・再利用を行ってはなりません。

第5条（利用者の遵守事項・禁止事項）

ユーザーは、本アプリを利用して映像を撮影・解析するにあたり、以下を含む事項を遵守するものとします。

撮影・解析する映像について、自らが正当な権利（自ら撮影した、権利者の同意を得た、または適用法上適法に公共の場で撮影・利用できる根拠がある等）を有していることを確認すること。
第三者の車両・ナンバープレート・容貌等が写り込む映像を、当該第三者の特定、追跡、嫌がらせ、ストーキング、名誉毀損その他の権利侵害を目的として利用しないこと。
自動車等の運転中に本アプリを操作しないこと（詳細は第6条および免責事項を参照）。
本アプリが算出する速度推定値を、取締り・訴訟・保険金請求その他の法的・証拠的用途の根拠として使用しないこと。
撮影・録画・プライバシーに関する適用法令（道路交通法、個人情報保護法、各国のプライバシー法等）を遵守すること。
法令または公序良俗に反する目的で本アプリを利用しないこと。

第6条（重要な免責事項）

本アプリが表示する速度推定値は、ユーザーが行うカメラ校正・撮影条件等に依存する近似値であり、法的・証拠的な速度測定を目的として設計された機器ではありません。取締り・訴訟・保険金請求等の根拠として使用することはできません。本アプリは運転中の操作を想定していません。詳細かつ完全な内容は免責事項ページをご確認ください。本条は同ページの内容を要約したものであり、本規約の一部を構成します。

第7条（知的財産権）

本アプリのソースコード、UI、デザイン、名称、ロゴその他一切のコンテンツに関する著作権および知的財産権は、当方または正当な権利者に帰属します。本条は、ユーザーに本アプリのコンテンツについていかなる権利も譲渡するものではありません。

第8条（技術的出典・オープンソースソフトウェア等の表示）

本アプリは、以下の技術・素材を利用しています。

Apple 標準フレームワーク

Vision（文字認識・矩形検出）、CoreMotion（モーションセンサー）、AVFoundation（映像処理）、SwiftData（端末内データ永続化）、CoreML ランタイム。いずれも Apple Developer Program の下で iOS アプリに利用が認められている Apple 提供のフレームワークです。

独自実装のアルゴリズム

車両追跡（ByteTrack + カルマンフィルタに基づく独自実装）、速度推定（ホモグラフィ／逆透視変換(IPM)に基づく独自実装）、日本のナンバープレート書式の検証ロジックは、いずれも本アプリの開発者が独自に実装したコードであり、外部のコピーレフト（AGPL等）ライブラリに依存しません。

車両検出モデルについて

本アプリの車両検出には、Apache License 2.0 で提供される機械学習モデル YOLOX-s（Megvii-BaseDetection）を CoreML 形式に変換して使用しています。推論はすべて端末内で行われ、映像や検出結果が外部へ送信されることはありません。

同梱サンプル動画

本アプリには、検出・追跡機能を試すためのデモ用サンプル動画が同梱されています。これらはユーザーが撮影した動画ではなく、以下の無料ストック動画サービスから取得した素材です。

Pexels License は帰属表示を義務付けていませんが、透明性のため出典を記載しています。素材そのものの再販や、Pexels・撮影者による推奨を装う利用は許諾範囲外です。
プリセット校正付きの高速道路サンプル1本は、教育・研究目的で公開されている参考動画（Roboflow「supervision」プロジェクトの video-examples 内 vehicles.mp4）を縮小加工したものです。当該素材固有の再配布条件は精査中であり、一般配布ビルドでは別素材への差し替えを検討しています。

第9条（保証の否認）

本アプリは現状有姿（AS IS）で提供され、当方は、正確性、完全性、特定目的への適合性、権利非侵害等について、明示・黙示を問わずいかなる保証も行いません。

第10条（責任の制限）

当方は、本アプリの利用または利用不能から生じるいかなる損害（速度推定値への依拠、交通違反、事故、映像に写り込んだ第三者からの請求を含むがこれに限らない）についても、適用法令が許容する最大限度において責任を負いません。

第11条（本規約の変更・提供終了）

当方は、事前の通知なく本規約を変更し、または本アプリの提供を中断・終了することがあります。重要な変更がある場合は、可能な範囲で本ページの更新またはアプリ内の告知により周知します。

第12条（準拠法・裁判管轄）

本規約は日本法に準拠し、これに従って解釈されます。本アプリまたは本規約に関連して当方とユーザーとの間に生じた紛争については、日本国の裁判所を専属的合意管轄裁判所とします。

📜Terms of Use

Article 1 (Acceptance)

These Terms of Use ("Terms") govern the relationship between an individual developer ("we", "us") and the user with respect to the use of the application "SpeedTracker" (the "App"). By downloading or using the App, the user is deemed to have agreed to these Terms.

Article 2 (Description of Service)

The App detects and tracks vehicles in videos selected by the user from the Photos library, or in live camera footage, and estimates and ranks vehicle speeds based on a road-plane homography (perspective transform). It also includes an auxiliary on-device feature that recognizes text such as license plates within the analyzed footage. All of this processing happens entirely on-device; footage and analysis results are never transmitted over any network.

Article 3 (Pricing and Purchases)

The App's offering and pricing (whether free, paid, or with in-app purchases) is authoritatively determined by what is displayed on the App's listing page on the Apple App Store. The store's displayed price prevails. Purchases, payments, and refunds are governed by the Apple App Store's own terms and policies; we do not, as a general rule, process refunds directly.

Article 4 (License)

We grant the user a limited, non-exclusive, non-transferable license to use the App for personal use only. The user shall not decompile, disassemble, or reverse-engineer the App, copy, redistribute, rent, or resell it, or extract or reuse any machine-learning model or asset bundled with the App.

Article 5 (User Obligations and Prohibited Conduct)

When capturing or analyzing footage using the App, the user shall comply with the following, among other obligations:

Confirm that they hold a legitimate right to the footage being captured or analyzed (e.g. footage they personally recorded, footage for which they have obtained the rights-holder's consent, or footage they may lawfully record/use in a public place under applicable law).
Not use footage in which third-party vehicles, license plates, or faces appear for the purpose of identifying, tracking, harassing, stalking, defaming, or otherwise infringing the rights of such third parties.
Not operate the App while driving a vehicle (see Article 6 below and the Disclaimer).
Not rely on speed estimates produced by the App as a basis for enforcement, litigation, insurance claims, or any other legal or evidentiary purpose.
Comply with all applicable laws relating to recording, filming, and privacy (e.g. road traffic law, personal information protection law, and other applicable privacy laws).
Not use the App for any purpose that violates applicable law or public order and morals.

Article 6 (Important Disclaimer)

Speed values displayed by the App are approximations dependent on the user's own camera calibration and shooting conditions; the App is not designed or certified as a legal or evidentiary speed-measurement device, and its output must not be used as a basis for enforcement, litigation, or insurance claims. The App is not intended to be operated while driving. See the full Disclaimer page for complete details; this Article is a summary of, and incorporates by reference, that page as part of these Terms.

Article 7 (Intellectual Property)

All copyright and other intellectual property rights in the App's source code, UI, design, name, logo, and other content belong to us or to the rightful rights-holder. Nothing in these Terms transfers any such rights to the user.

Article 8 (Technical Attributions / Third-Party and Open-Source Notices)

The App uses the following technologies and materials.

Apple Frameworks

Vision (text/rectangle recognition), CoreMotion (motion sensors), AVFoundation (media processing), SwiftData (on-device persistence), and the CoreML runtime. These are Apple-provided frameworks whose use in iOS apps is permitted under the Apple Developer Program.

Original Algorithms

Vehicle tracking (an original implementation based on ByteTrack + a Kalman filter), speed estimation (an original implementation based on homography / inverse perspective mapping), and Japanese license-plate format validation logic are all code originally written by the App's developer and do not depend on any external copyleft (e.g. AGPL) library.

Vehicle Detection Model

The App uses YOLOX-s (Megvii-BaseDetection), a machine-learning model provided under the Apache License 2.0, converted to CoreML for on-device vehicle detection. All inference runs on-device; no video or detection result is transmitted externally.

Bundled Sample Videos

The App includes demonstration sample videos for trying out its detection and tracking features. These are not footage recorded by any user, but material obtained from the following free stock-video services.

Videos under the Pexels License (free, commercial use permitted, modification permitted), depicting racing, motorcycle, highway, and road scenes. Source pages for each clip:

The Pexels License does not require attribution, but source links are provided here for transparency. Reselling the stock material itself, or using it in a way that implies endorsement by Pexels or the original creator, is outside the scope of the license.
One highway sample with a preset calibration is a downscaled version of a reference video (vehicles.mp4) published for educational purposes as part of the Roboflow "supervision" project's video-examples. The specific redistribution terms of this particular clip are still under review, and it may be replaced with alternative material in the generally released build.

Article 9 (No Warranty)

The App is provided "AS IS." We make no warranty of any kind, express or implied, including as to accuracy, completeness, fitness for a particular purpose, or non-infringement.

Article 10 (Limitation of Liability)

To the maximum extent permitted by applicable law, we shall not be liable for any damages arising from the use or inability to use the App, including but not limited to damages resulting from reliance on speed estimates, traffic violations, accidents, or claims brought by third parties who appear in analyzed footage.

Article 11 (Changes to These Terms; Discontinuation)

We may modify these Terms, or suspend or discontinue the App, without prior notice. Where feasible, material changes will be communicated by updating this page or through an in-app notice.

Article 12 (Governing Law and Jurisdiction)

These Terms are governed by and construed in accordance with the laws of Japan. The courts of Japan shall have exclusive jurisdiction over any dispute arising between us and the user in connection with the App or these Terms.
